Sledding Teen Hit by Car and Breaks Leg

A teenager that went out sledding after school on a local sledding hill hit a bump that sent him onto the road and into the path of an oncoming car.

His leg was broken in the accident. The teen was using a blue saucer sled when he went onto Merriam Lane. The sledding hill is located on private property and the teen did not have permission to be there.
Defective Product Suits Cost Ford Millions

Ford's litigation policy of refusing to settle defective product claims reportedly cost the automaker over $255 Million. Hopefully these large jury verdicts will send a message that the public is not going to tolerate corporate irresponsibility any longer.

You can read more about this story in the St. Louis Post Dispatch.

I believe that large corporations adopt this type of strategy hoping that their size and money will prevail over justice. It is up to us trial lawyers to level the playing field for the victims of corporate greed and irresponsibility.

Originally posted at InjuryBoard by Staff Writer

Rear-End Collision - Who is at Fault?

If you rear-end another vehicle can you maintain a viable claim against that driver? Recently, a prospective client contacted me with this question. In that case, driver 1's car stopped running and was stationary in the right hand lane of traffic on a bridge. Driver 2, was an SUV that failed to stop in time and struck Driver 1. Driver 3 (prospective client) was in a small car behind the SUV and Driver 3's view was obstructed of Driver 1 due to the size of Driver 2's SUV. Driver 3 rear-ended Driver 2.

Missouri is a pure comparative fault state. This allows the judge / jury to compare the fault of each party. At the conclusion of the trial the judge / jury would decide what degree of fault (0 to 100) each driver has. Driver 3's recover will be reduced by the amount of fault allocated to her (ie $100,000 verdict with 25% fault means she would receive $75,000).

Under this scenario Driver 1 has a duty to try and get as far off the road as possible when the car loses power. Driver 1 also has a duty to warn other drivers of the situation (i.e. put out flares, etc.) Driver 2 has a duty to keep a careful look out and avoid the collision with Driver 1. Driver 3 also has a duty to keep a careful lookout. In this case all three drivers will probably get assessed some degree of fault. Driver 3 still has a viable claim against both Drivers 1 and 2. The degree of fault assessed against those respective drivers would depend on several factors, how long Driver 1 was sitting stationary, how fast Driver 2 was going, etc.

Originally posted at InjuryBoard by Staff Writer

Police Car Accident Lawsuit Settled For $3M

The city of Grandview has agreed to pay nearly $3 million to the family of an Overland Park teen who was injured when broadsided by a city police car that went through a red light while chasing a stolen car in Leawood, Kansas.

Emma Rothbrust was a passenger in the car broadsided by officer Brian Blessing in November 2004. She was unable to walk until spring 2005, and according to her father:

the money will be used for his daughter's medical care. She underwent a half-dozen surgeries after suffering injuries that included a shattered pelvis, a broken tibia and fibula, broken ankles; and punctured, torn and bruised lungs, heart, kidney and bladder.

The issue of police chases has been hotly debated with opponents questioning their safety and whether innocent drivers are unnecessarily put in harm's way.

The KC Star has more: Car Accident

Originally posted at InjuryBoard by Staff Writer

Kansas City Settles Wrongful Death Lawsuit

The city of Kansas City has agreed to a settlement of $300,000 with the family of a college student killed when the car he was riding in skidded on a patch of ice caused by a water main break. The student was home for Christmas Break from UM-Columbia in December 2004.

The plaintiffs' attorney said neighbors had reported the water main break earlier in the day and warned that the water flowing over the road was creating dangerous icy conditions. But the problem was not immediately fixed.

This is the city's second settlement of its kind since August when it paid $224,000 to a woman injured after slipping on ice from a leak that had been there for years.

Originally posted at InjuryBoard by Staff Writer
